By placing an order on www.JonesOfArt.com, you acknowledge that you are bound by the terms and conditions listed below:
Modification
Please review these terms and conditions on a periodic basis as (Jennifer Jones) JonesOfArt.com reserves the right to modify, alter, or update any condition from time to time and at the sole discretion of JonesOfArt.com.
Electronic Communications
When you browse through the JonesOfArt.com website or send email to us, you are communicating with me (Jennifer Jones) electronically. In a similar manner, (Jennifer Jones) JonesOfArt.com will also communicate with you by sending emails or posting notices on this website. You agree that all such agreements, notices, disclosures and other communications that (Jennifer Jones) JonesOfArt.com provides to you electronically satisfies any legal requirement that such communications be in writing. The user agrees to abide by all provisions prescribed in the order forms submitted for the purchase of paintings from the websites. In particular, the user warrants that all information that they submit will be true and accurate (including without limitation, their credit card number and expiration date and ownership of rights to photographs). The user also agrees to pay all charges plus all applicable taxes for the purchases made by them.
Photography Release
Any photograph or image that is sent by you to (Jennifer Jones) JonesOfArt.com is subject to the following terms and conditions:
1. You represent and warrant to (Jennifer Jones) JonesOfArt.com that you are the sole creator, producer, photographer and/or author of this photograph or image and that you have sole copyright ownership of this photograph or image. You further represent that if a photographer was hired by you to take this photograph or image that you have obtained an assignment of copyright from said photographer or have obtained a license which allows you to make reproductions or derivative works based on said photograph or image.
2. You represent that you have secured written right of privacy releases from all persons depicted in the photograph, image or portrait.
3. You hereby grant (Jennifer Jones) JonesOfArt.com the right to copy, publish, and use the provided photograph or image for any lawful purpose, including for an original fine art reproduction.
4. You further hereby agree to hold (Jennifer Jones) JonesOfArt.com not responsible for any damage to or loss from photographs or images sent to (Jennifer Jones) JonesOfArt.com.
Cancellation
At any prior stage to making the payment for the product, the user may cancel their order without any cancellation charges becoming applicable. Once payment has been remitted to the website and prior to dispatch of the product, any cancellation will incur a nominal service charge. (Jennifer Jones) JonesOfArt.com will deduct this amount before returning the payment to the customer. If (Jennifer Jones) the artist has already begun work on your painting and up to the point of completion of your painting, you are liable for 20% of the purchase price. The remainder will be refunded to you.
Return Policy
JonesOfArt.com offers a 100% satisfaction guarantee in the paintings from your photo. I (Jennifer Jones) will send you a photo of your painting when it is completed. If, for any reason, you are not satisfied, I (Jennifer Jones) will correct the painting. In rare cases where I (Jennifer Jones) cannot provide you with a painting to your satisfaction, I (Jennifer Jones) will refund 100% of your advance amount.
If you receive the painting and it is damaged, notify (Jennifer Jones) JonesOfArt.com within 48 hours and request a return authorization. Return the painting to (Jennifer Jones) JonesOfArt.com with the return authorization and packing slip and I (Jennifer Jones) will either fix the painting or commission a replacement painting.
